BUSINESS TERMS AND CONDITIONS

INTRODUCTORY PROVISIONS

  1. These terms and conditions (hereinafter referred to as the „Terms“) govern the rights and obligations between: Stanislav Florián, Company ID: 72296283, with registered office at Březolupy 517, e-mail: obchod@florinacestach.cz (hereinafter referred to as the "Seller") and natural persons - consumers who purchase digital content through the online store on the website florinacestach.cz (hereinafter referred to as the „Buyer“).
  2. The seller is the author of the offered e-books and is authorized to sell them.

PURCHASE SUBJECT – DIGITAL CONTENT

  1. The subject of the order is digital content – e-book in format PDF, delivered electronically via a download link.
  2. A description of the content and a sample are always provided for a specific e-book on the Seller's website.

ORDER AND CONCLUSION OF THE CONTRACT

  1. The buyer creates an order by following these steps:
  2. On the Seller's website, they click on the button to purchase the e-book, which redirects them to a secure sales form.
  3. They fill in their first name, last name and email address in the sales form.
  4. Tick the box to agree to these Terms and Conditions, the Privacy Policy and express consent to the start of the provision of digital content before the 14-day withdrawal period expires.
  5. Complete and submit the order by clicking the button „"Order with payment obligation"“.
  6. After sending the order, the Buyer will be shown a page with payment details and the Seller will also deliver the payment documents to the Buyer's email address.
  7. The purchase contract is concluded at the moment the order is sent by the Buyer.

PAYMENT AND PAYMENT GATEWAY

  1. Payment options for digital content:
    • Online payment (card payment / fast bank transfer): Immediate payment via Comgate payment gateways.
    • Classical bank transfer (or QR code): Payment to the Seller's account held at Raiffeisenbank: 8093341002/5500. The Buyer is obliged to provide the data specified in the payment instructions as a variable symbol. In this case, the order is processed and the digital content is made available only after the payment is credited to the Seller's account and matched in the system.
  2. Payment gateway provider: The payment gateway provider is Comgate, as. More information about the payment gateway and its services can be found at: https://www.comgate.eu/cs/platebni-brana
  3. Online payment process:
    • Payment by card: After submitting the order, the Buyer is redirected to a secure payment gateway interface, where he enters his payment card details (card number, expiration date and CVC/CVV code) and confirms the payment. The payment is processed immediately and after approval, the digital content is immediately available.
    • Fast bank transfer (bank buttons): After submitting the order, the Buyer is redirected to the gateway interface, where he selects his bank. He is then redirected to his online banking with a pre-filled payment order, which he only authorizes.

DELIVERY OF DIGITAL CONTENT

  1. After successfully matching the payment, the Buyer will receive the following email address:
  2. confirmation of payment (tax receipt/invoice) and
  3. link to download the purchased e-book in PDF format.
  4. The download link is valid for repeated downloads in accordance with the technical settings of the system.
  5. Digital content is provided one-time, without entitlement to future updates.

TECHNICAL REQUIREMENTS

  1. To download and read an e-book, you need a device that can open PDF files and access the internet.
  2. The Buyer is responsible for having appropriate technical equipment and software.

COPYRIGHT

  1. The e-book is a copyrighted work protected under Act No. 121/2000 Coll., the Copyright Act.
  2. The buyer only obtains a non-exclusive license to use the digital content for his own personal use.
  3. The Buyer is prohibited from copying, distributing, providing to third parties, modifying, commercially distributing by printing or otherwise further processing the work without the written consent of the Seller.

RIGHT TO WITHDRAW FROM THE CONTRACT

  1. Digital content not supplied on a physical medium.
  2. The buyer does not have the right to withdraw from the contract within the 14-day period pursuant to Section 1837 letter l) of the Civil Code, because before the delivery of the digital content, he gives explicit consent to the commencement of performance before the expiry of the withdrawal period and acknowledges that his right to withdraw from the contract expires with this consent.
  3. If the link to download the e-book has not yet been delivered to the Buyer (e.g. payment has not yet been made), you can request cancellation of the order by e-mail to obchod@florinacestach.cz.

RIGHTS FROM DEFECTIVE PERFORMANCE (COMPLAINT)

  1. The Seller is responsible to the Buyer for ensuring that the digital content is made available in accordance with the contract and in adequate quality.
  2. A defect is understood to mean, in particular, a non-functional download link, a damaged file or content that fundamentally does not correspond to the description.
  3. Defects can be reported by email at obchod@florinacestach.cz.
  4. The seller undertakes to assess and resolve the complaint no later than 30 days from its delivery.

OUT-OF-COURT RESOLUTION OF CONSUMER DISPUTES

  1. The Czech Trade Inspection Authority, with its registered office at Štěpánská 567/15, 120 00 Prague 2, ID: 00020869, internet address: [https://www.coi.cz](https://www.coi.cz), is responsible for the out-of-court resolution of consumer disputes arising from the purchase contract.
  2. The online dispute resolution platform located at the internet address [http://ec.europa.eu/consumers/odr](http://ec.europa.eu/consumers/odr) can be used to resolve disputes between the seller and the buyer arising from the purchase contract.

PERSONAL DATA PROTECTION

  1. The Seller processes the Buyers' personal data to the extent necessary to process the order.
  2. Details on the processing of personal data are provided below in a separate section entitled Personal Data Processing Policies.

FINAL PROVISIONS

  1. These Terms are valid and effective from the date of their publication.
  2. The Seller reserves the right to change the Terms and Conditions; the relationship between the parties is always governed by the version valid at the time the order is sent by the Buyer.
  3. Rights and obligations not regulated by these Terms and Conditions are governed by the Civil Code and related legal regulations of the Czech Republic.
